Copyright and takedowns

Our policy

Owners may upload only photos and words they created or have permission to use. When we receive a notice that meets the requirements below, we take the material down or block access to it, and we tell the person who posted it.

We close the accounts of people who infringe again and again. For counsel — confirm: The repeat-infringer policy the safe harbor requires, and who decides.

Asking us to take something down

Send our designated agent a written notice with all of the following. The U.S. Copyright Act (17 U.S.C. §512(c)(3)) sets these out:

1. your physical or electronic signature, as the copyright owner or someone authorized to act for them;
2. the work you believe was copied, such as your photograph;
3. where it is on listedby.ai: the listing’s web address, and which photo or which words, so we can find it;
4. your name, mailing address, phone number and email address;
5. a statement that you believe in good faith that the use isn’t authorized by the copyright owner, its agent or the law; and
6. a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for them.

Where to send it

Our designated agent for copyright notices, to be registered with the U.S. Copyright Office:

For counsel: The designated agent's name, mailing address, email and phone, once registered with the U.S. Copyright Office.

This address is for copyright notices only. Other messages sent to it may not get an answer.

If your photo or words were taken down

If we took down something you posted and you believe it was a mistake or a misidentification, you can send our designated agent a counter-notice with all of the following (17 U.S.C. §512(g)(3)):

1. your physical or electronic signature;
2. what was taken down, and where it appeared before;
3. a statement, under penalty of perjury, that you believe in good faith it was taken down by mistake or misidentification; and
4. your name, address and phone number, a statement that you consent to the jurisdiction of the federal district court for the district where your address is (or, outside the United States, any district where we may be found), and that you will accept service of process from the person who sent the notice, or their agent.

We send a copy of your counter-notice to the person who sent the notice. Unless they tell us they have gone to court to keep the material down, we put it back 10 to 14 business days after we receive your counter-notice.

Be accurate

Under 17 U.S.C. §512(f), anyone who knowingly and materially misrepresents that material infringes, or that it was taken down by mistake, can be liable for the damages that causes. If you aren’t sure the use infringes, talk to a lawyer before you send a notice.

Your photos on another site

This page covers material on listedby.ai. If your listing’s photos turn up on another site, for example in a fake rental ad, send your notice to that site. Safety explains the rental scam.
